AGREEMENT FOR ACCESSING CITEULIKE

Important Notice

These terms and conditions will apply when you access CiteULike. Before proceeding to access our site, we ask that you read these terms and conditions carefully.

By accessing our site you agree to be legally bound by these terms and our Privacy Policy as they may be modified , without prior notice, from time to time.

Conditions of Use of CiteULike

1. General Information

1.1 We are Oversity Limited and our address is Centre 500, 500 Chiswick High Road, London, W4 5RG. Our e-mail address is citeulike@citeulike.org and our Web site, CiteULike, is www.citeulike.org. We subscribe to the following codes of conduct.

2. Posting Material on CiteULike

2.1 You agree not to post or transfer to CiteULike (nor include in any message) any material which is obscene, misleading, inaccurate, defamatory, threatening, illegal, in breach of any copyright or other intellectual property right, or damaging to data, software or the performance of our or any other party's computer system.

3. Accessing Material on CiteULike

3.1 You acknowledge that CiteULike is provided on an as-is basis and makes no representations or warranties of any kind with respect to CiteULike or its contents and disclaims all such representations and warranties. In addition, we make no representations or warranties about the accuracy, completeness, or suitability for any purpose of the information and related graphics published in CiteULike. The information contained in CiteULike may contain technical inaccuracies or typographical errors. All of our liability howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

3.2 Notwithstanding clause 3.1, none of the exclusions and limitations in the clause are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded nor in any way to exclude or limit our liability to you for death or personal injury resulting from our negligence or that of our employees or agents.

4. Data Protection

4.1 The Data Protection Act 1998 is designed to protect individuals about whom information is entered and stored on computer and other systems. Accordingly, it lays down strict standards of accuracy, relevance and care of such data including how it may be divulged. Any data about individuals you enter onto CiteULike directly or include in any message to us will be subject to the Act and you are responsible for its accuracy and relevance and must have the authority to disclose it and for us to utilise it for the purposes of any transaction concluded for or by you through CiteULike. If you are in any doubt about any data please feel free to e-mail us with details of the problem first.

5. Offensive Material

5.1 As soon as we are made aware of activities that breach these Terms of Use or our Privacy Policy, prompt action will be taken. If you witness any such breach on CiteULike you undertake to notify us immediately at abuse@citeulike.org.

5.2 On being made aware of any such breaches, we may ban, delete or prohibit any content that relates to those breaches or that we judge harmful to individuals or our rights or any of our affiliates, licensors or partners. All incidents will be logged and our decision will be final in such cases. In addition we may at any time move, modify or remove any content or take further legal action as a result of breaches or suspected breaches of these rules, our privacy policy, any applicable rules or regulations or where our rights or those of a third party are infringed.

6. Intellectual Property

6.1 In consideration of agreeing to your use of CiteULike, you acknowledge that the ownership in any intellectual property rights (including, for the avoidance of doubt, copyright) in CiteULike belongs to us. Accordingly, any part of CiteULike (or its source HTML code) may not be used, transferred, copied or reproduced in whole or in part in any manner other than for the purposes of utilising CiteULike meaning that you may only display it on your computer screen and print it out on your printer for the sole purpose of viewing its content.

7.1 We do not make any warranties, representations or undertakings about the content of any other Web site which may be referred to or accessed by hypertext link from CiteULike, and we do not endorse or approve the content of such third party Web sites.

8. Jurisdiction

8.1 Use of CiteULike is subject to the laws of England and Wales, and the exclusive jurisdiction of the English Courts.

CiteULike organises scholarly (or academic) papers or literature and provides bibliographic (which means it makes bibliographies) for universities and higher education establishments. It helps undergraduates and postgraduates. People studying for PhDs or in postdoctoral (postdoc) positions. The service is similar in scope to EndNote or RefWorks or any other reference manager like BibTeX, but it is a social bookmarking service for scientists and humanities researchers.
